Client Service Terms

1. Scope
First Measure provides portfolio strategy, evidence-based content development, visual design, website development, deployment, and related services as described in the applicable Client Service Agreement and Project Order or other written agreement. A client-specific written agreement controls if it conflicts with these general website terms.
2. Client materials
The client is responsible for providing accurate, lawful, and usable source materials and for having the right to provide any text, images, documents, trademarks, or other materials submitted for use in the portfolio.
3. Scope and revisions
Each package includes the deliverables and revision rounds identified in the applicable service description or proposal. Requests beyond the agreed scope may require additional time or fees and will be confirmed before work proceeds.
4. Portfolio direction and approval
First Measure may present a Portfolio Direction or similar strategy for client review before production. Approval of that direction authorizes First Measure to proceed with the approved approach. Material changes after approval may be treated as additional scope.
5. Payment
Fees, deposits, balances, and payment timing will be stated in the applicable proposal, invoice, or written agreement. Work may be paused until required payments are received.
6. Ownership and delivery
Unless otherwise stated in writing, the client receives the completed portfolio deliverables and applicable source files after payment of all amounts due. Third-party software, fonts, stock assets, hosting services, and other components remain subject to their own licenses and terms.
7. AI-Assisted Services
First Measure may use AI-assisted tools as part of its analysis, drafting, organization, visual development, software development, testing, and quality assurance processes. These tools support services performed by First Measure and are not offered to clients or website visitors as an autonomous artificial intelligence service.
First Measure applies professional human review and its evidence-integrity process to delivered work. AI-assisted work may contain errors and may include general concepts or components similar to material generated for others. The client remains responsible for reviewing final portfolio content for factual accuracy, suitability, and authorization before publication.
Use of AI-assisted tools does not authorize First Measure to invent employment, credentials, accomplishments, responsibilities, projects, results, testimonials, or other unsupported evidence. Ownership of final client deliverables, client-supplied materials, First Measure reusable materials, and third-party components remains governed by the applicable Client Service Agreement and Project Order.
8. Minors and Guardian Authority
First Measure does not knowingly contract directly with a minor. When the portfolio subject is under eighteen, the client must be the subject's parent or legal guardian and must provide the required approvals and authorization.
A portfolio involving a minor will not be published without express approval from the parent or legal guardian. Guardian authorization for portfolio publication does not automatically authorize First Measure to use the minor's name, likeness, portfolio, screenshots, or story for marketing.
9. Hosting and launch
When deployment or launch services are purchased, First Measure may configure and publish the portfolio using the hosting, access, domain, and source-control arrangements stated in the applicable Project Order. Deployment may use First Measure-managed hosting, a supported restricted-access arrangement, a portable static-hosting provider, or a client-controlled environment.
Domain ownership, DNS management, repository ownership, hosting responsibility, access restrictions, included management periods, renewals, and source handoff are separate responsibilities and will be identified in the applicable Project Order.
10. Portfolio use and samples
First Measure will not publicly display a client's portfolio, name, or work as a sample unless the applicable agreement or client permission allows it.
11. Accuracy and legal rights
The client is responsible for reviewing the final portfolio for factual accuracy and confirming that public materials do not contain confidential, restricted, or third-party material that cannot lawfully be published.
12. Cancellation and refunds
Any cancellation, rescheduling, or refund rights will be governed by the applicable proposal or written agreement. Work already completed may be non-refundable to the extent permitted by law.
13. Limitation of liability
To the maximum extent permitted by law, First Measure's liability arising from a service will be limited to the fees actually paid for that service, except where a different limitation is required by applicable law.
14. Changes
These terms may be updated from time to time. Client-specific agreements control where they conflict with these general terms.
